BOUNTIFUL - The Bountiful City Council has unanimously approved an ethics commission.

“We’ve never had a complaint like that, but there never has really been a mechanism” to file such a complaint, City Attorney Russell Mahan said.

Bountiful actually becomes part of a new municipal ethics commission that also includes the cities of Clearfield, Layton and Roy.

If a resident files a complaint from one city, his or her city attorney would not take part in deliberations. Rather, the city attorneys from the other three communities would act as a commission on that matter, Mahan explained.

The city council’s action follows on legislation approved by the Utah State Legislature in 2012. It established the statutory right of individuals to file an ethics complaint against a municipal official or employee.

That bill set up a state ethics commission to hear such complaints. It also allowed cities to form their own commission. Some cities have done that while others have defaulted to the state body, Mahan said.

No complaints have been filed and heard by the state ethics board, he said.

If a complaint was filed, the ethics commission would evaluate the complaint, take evidence and enter findings, Mahan said in material provided to the city council.

If a violation of the Municipal Officers’ and Employees; Ethics Act was found, the commission would recommend to the respective city council “any appropriate remedy, including but not limited to censor, reprimand, additional ethics training, or removal from office.”

The particular city would need to determine what action it should take, Mahan said.
