Cruz to be sentenced April 1

FARMINGTON — Robert Santos Cruz will be sentenced on April 11 in 2nd District Court, after pleading guilty to burglary.

Cruz, 47, was identified as the man who stood in the doorway of Clare B. Neiderhauser’s Layton home on Jan. 31, holding a pry-bar and later running into the backyard, where Niederhauser fired a handgun.

Cruz pleaded guilty to a reduced charge of third-degree felony burglary.

Niederhauser was arrested after he fired the handgun at Cruz and a get-away car. 

He agreed to a plea deal on a class B misdemeanor. The deal included paying $700 in court fees, which do not constitute a fine, taking a weapons safety class, forfeiting the .357 caliber handgun he used that day, and relinquishing his concealed weapons permit for a time.
