Teen waives preliminary hearing in deaths

FARMINGTON — The teen accused of killing his two younger brothers in May waived his right to a preliminary hearing on Tuesday.

Aza Vidinhar, 15, was in 2nd District Juvenile Court for the short hearing. He sat quietly between his father and his attorneys. Vidinhar’s father has been at all the hearings held for his son, sitting with him during the proceedings. Several family members were also in court for the hearing.

One of Vidinhar’s two attorneys, Todd Sessions, said in court there is enough evidence for prosecutors to charge Vidinhar. However, he told Judge Janice Frost his client is not guilty of the charges.

Davis County prosecutors have said they will seek to have the teen certified and tried as an adult, but his attorneys maintain he should not be certified as an adult because he was barely 15 when the crime occurred.

Following the hearing, Vidinhar’s other attorney, Todd Utzinger said his client is aware of the gravity of the situation,

Vidinhar is accused of stabbing his two younger brothers, Alex, 10 and Benjie, 4, on May 22, in the family’s West Point home.

The boys were found by their mother that afternoon with multiple stab wounds.

The teen was not home when the bodies were discovered, and a missing person alert was initially issued. Police found the teen about 11:30 p.m. walking down a street in Layton. Police said he did not have a weapon, but traces of blood were found on him.

He was booked into the Farmington Bay Youth Detention Center on suspicion of two counts of homicide.

A hearing to discuss motions has been set for Oct. 8. Among those motions will be requests  from the defense attorneys for documents from outside agencies.
