The Bob Bennett article, “‘Taking back’ federal lands unlikely”, (which appeared in some daily newspapers earlier this month), shows why the conservatives chose Mike Lee over Bob Bennett.
Although I generally like Bob Bennett very much, he gets too liberal at times and is a Washington Establishment-type person. His article explains why it is hopeless to “Take Back” state lands under control of the federal government (feds), but he and the state are missing the point: It does not matter whether the feds should give back to Utah all of the lands within the Utah borders, but whether the feds have the right to control any lands within the Utah borders, or any other state.
Article I, Section 8, paragraph 17 of the U.S. Constitution gives no rights to the feds to control state lands other than Washington, D.C., and military sites “purchased by the Consent of the Legislature of the State”. Therefore, the Feds have no legal rights to any lands, except those mentioned in Article 1, Section 8. We need to fight the feds over control of federal lands based upon the U.S. Constitution!
