Felony charges filed in weekend murder

FARMINGTON -- First degree felony murder charges were filed Tuesday against Phillip Joseph Simmons, 35, accused of the weekend murder in Bountiful of Suzanne Fry. At a hearing in 2nd District Court, mental evaluations were ordered to determine Simmons' competency. Court documents show that prosecutors believe Fry was killed during an argument over a meal. Simmons allegedly told police that the word "murder" flashed in his mind, then he blacked out. The next thing he was aware of was blood everywhere and Fry lying on the floor.

Fry was found dead late Saturday night. Police say she had been stabbed 21 times with a steak knife.

Officers say that when they arrived, they found Fry's apartment destroyed.They found all the glassware and dishes shattered, pictures destroyed and a china hutch tipped over.

Shortly after, Simmons was spotted about a block away by a patrol officer. He was dressed only in a T-shirt, pants and shoes and had blood on his hands and T-shirt. Tuesday's court documents reveal Simmons told the officer that "a lady had been murdered," and that he later told officers, "he had done something bad."

The court documents say that Simmons told investigators he had fixed a plate of food, then an argument occurred over the food, and that "in his mind he heard the word 'murder' and a knife came out and then he blacked out," Davis County Attorney Troy Rawlings wrote in the probable cause statement.

Police say that during his interview Simmons rambled incoherently, and on Tuesday both the prosecution and defense admitted to competency issues. During the hearing Simmons reportedly appeared to be mumbling to himself and looked at the floor.

He remains in the Davis County Jail. Bail was set at $100,000.

Fry was a widow who lived at the Birches Apartments, 2135 S. Main, Bountiful.

Police found personal items of Simmons in her apartment and believe he may have been living there at least some of the time, although family and friends have said they know nothing about such an arrangement.
