There could’ve been a snag, for the Tesoro convenience store, 14 N. Fort Lane, on the northwest corner of Fort Lane and Gentile.
After city staff had given preliminary approval to issuance of the license, it was determined the store is within 600 feet of the Family Worship Center, 55 N. Fort Lane, in a building that was formerly a medical equipment supply business.
The convenience store was built and had appropriate licenses long before the church occupied its current building, a few years ago, leading to the oversight, the city council was told.
State law requires a 600-foot buffer zone between a license-seeker and a church, school, library, park, or playground.
The buffer zone exists unless the city council believes these restrictions cause “undue hardships” upon a business, it was explained during a recent council meeting.
The council can grant exceptions or propose additional restrictions, depending on the situation, city staff explained.
“I believe we can grant undue hardship because there are several other gas stations within close proximity of the Tesoro, who will be competing for business,” said council member Joyce Brown.
The council agreed.
