Kingston lawyer must answer clan questions, says U.S. judge

SALT LAKE CITY ó A federal magistrate has ruled that an attorney associated with the Kingston polygamist clan must answer questions about the clan. ##M:MORE##

Last week, U.S. Judge Paul Warner said that Carl E. Kingston must participate in a deposition and answer questions about allegations of sexual abuse, incest and polygamy within the Davis County Cooperative Society.

The information is being sought by attorneys for Mary Ann Nelson, a defendant in a defamation lawsuit brought by Stephen Kingston and Ted Kingston.

In an April deposition, Carl Kingston had objected to disclosing the name of the father of his deceased sisterís two children. He asked Warner to deny the request, which the judge refused, saying he found nothing ìunreasonably annoying, embarrassing or oppressiveî in the questions Kingston was asked to answer.

Warner said Kingstonís objections appeared to be aimed at hindering discovery in the case.

Stephen Kingston and Ted Kingston say they were defamed in a press conference in 2004 during which Nelson and her attorneys announced they were seeking $110 million from the society and individuals after she was beaten for fleeing an illegal marriage to an uncle.

That lawsuit is still pending in 3rd District Court.
